UT SELECT prescription drug plan administration, Express Scripts: contract transparency report rows only

What this document is

These are two copies of the University of Texas System Administration Contract Transparency Report, a spreadsheet the UT System controller generates listing contracts by number, vendor, total value, term, amendment flag, commodity and procurement method. The first report covers 8/23/2022 through 1/30/2025 and runs 16 pages; the second covers 8/6/2025 through 9/10/2026 and runs 13 pages (page 1 of each). Between them, two rows concern Express Scripts and the UT SELECT prescription drug plan. The rest of the pages list architects, hotels, software and other purchases that have nothing to do with pharmacy. No agreement is posted.

What it does tell us

Row BA 2023-319, dated 3/23/2023, lists "Express Scripts, Inc." with a total value of $34,585,000 and a term of "9/1/19-8/31/25" (written that way in the report), an amendment flag of Y, the commodity "Pharmacy Benefits Management" and the procurement method "Ed. Code 51.9335--Best Value" (2023 report, page 6). Row BA 2026-130, dated 10/29/2025, lists "Express Scripts Inc." with a total value of "$0," a term of "3/19/25 - 3/18/26," amendment flag Y, and the description "Amendment: adding EGWP services" (2026 report, page 9).

So the UT System has had Express Scripts as pharmacy benefit manager for UT SELECT since September 1, 2019, the arrangement carried a total value of $34,585,000 when the 2023 entry was made, and a 2025 amendment added EGWP services at no stated additional value. The citation to Education Code 51.9335 and "Best Value" tells us the procurement authority, not how bids were scored or who else bid. The controller's contract summaries page, from which these reports come, says an open records request must be filed for anything beyond these rows.

Why it cannot be scored

Two spreadsheet rows carry a vendor name, a dollar figure and a date range. They carry no clause. We do not know whether the $34,585,000 is administrative fees, an estimate of drug spend or something else, what the rebate terms are, whether UT pays pass through or spread pricing, whether it can audit, or how the 2025 EGWP amendment changed the deal. The rows show the base term ending August 31, 2025 and the EGWP amendment running to March 18, 2026, and nothing after that, so whatever governs UT SELECT pharmacy benefits today is not visible here. Our checklist grades contract language, and a summary row is the opposite of contract language: it is what is left after every term has been stripped out.

A UT System employee, retiree or Texas resident can ask the UT System under the Texas Public Information Act for the executed pharmacy benefits management agreement with Express Scripts, Inc. recorded as BA 2023-319, with all exhibits and the pricing, rebate and performance guarantee schedules, every amendment including BA 2026-130, and any successor agreement or extension for UT SELECT pharmacy benefits after August 31, 2025. The UT System's own page invites that request, so the path is already marked.
